These Terms and conditions (“Terms”) govern your access to and use of the Australian Fashion Institute website and all products, services, courses, patterns and materials provided through it.
By accessing or using this website, purchasing a course or downloading any materials, you agree to be bound by these Terms.
1. Business information
The Australian Fashion Institute is operated by Clarke Holdings Group Pty Ltd (“Australian Fashion Institute”, “AFI”, “we”, “us” or “our”).

2. Acceptance of Terms
By accessing our website or purchasing any products or services, you confirm that:
you have read and understood these Terms
you agree to be legally bound by them
you are at least 18 years of age or have the consent of a parent or guardian.

3. Use of the Website
You agree to use the website only for lawful purposes.

The Australian Fashion Institute offers digital products and services including but not limited to:
online fashion courses
sewing and garment construction patterns
educational resources and training materials.
Orders
After placing an order you will receive confirmation by email. This email confirms receipt of your order but does not constitute acceptance until the order has been processed and access to digital materials has been granted.
Pricing
All prices are listed in Australian Dollars (AUD) and include applicable taxes unless otherwise stated. Prices may be updated at any time without notice.
5. Course accreditation and certification
The courses provided by the Australian Fashion Institute are independent professional training programs and are not nationally accredited qualifications.
Unless explicitly stated otherwise, our courses:
are not accredited under the Australian Qualifications Framework (AQF)
are not delivered by a Registered Training Organisation (RTO)
do not provide nationally recognised training.
Some courses may provide a certificate of completion issued by the Australian Fashion Institute. These certificates confirm participation and completion but do not represent an accredited qualification.
Students are responsible for determining whether any training meets their personal or professional requirements before enrolling.
6. Accounts and access
To access certain services you may be required to create an account.
You are responsible for:
maintaining the confidentiality of your login credentials
all activity conducted through your account.
You must notify us immediately if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts where:
these Terms are breached
course materials are shared or distributed
fraudulent activity is suspected.
7. Digital course access
When you purchase a course, you are granted a limited, personal, non-transferable license to access the course materials.
Unless stated otherwise:
course access is intended for the purchasing individual only
course login details must not be shared
course materials may not be downloaded, copied or distributed beyond what is explicitly permitted.
We reserve the right to:
update or modify course content
discontinue or replace course materials
revoke access if these Terms are breached.
8. Intellectual property
All materials available through the Australian Fashion Institute remain the exclusive intellectual property of the Australian Fashion Institute and Clarke Holdings Group Pty Ltd.
This includes but is not limited to:
sewing patterns
course videos
training materials
written guides
design templates
drawings and documents
educational frameworks and methods.
These materials are protected by Australian copyright law and international intellectual property laws.
No ownership rights are transferred to users.
9. License to use patterns and materials
We love supporting emerging designers and independent sewers, that’s why this license gives you freedom to create, sell and grow. But the pattern files and course resources remain the protected property of Australian Fashion Institute and must not be shared or sold in any form.
The Australian Fashion Institute grants users a non-exclusive, non-transferable licence to use purchased patterns and materials subject to these Terms.
Permitted Uses
You may:
sew garments for personal use
sew garments to sell on a made-to-order or small production basis
build a portfolio
create garments for clients or personal fashion businesses.
You may present garments made using our patterns as part of your own creative work.
Prohibited Uses
We offer generous creative freedom with our patterns, courses and content. You're welcome to use our patterns to create and sell garments, build a portfolio or launch your own made-to-order business.
However, to protect the integrity of this course and our intellectual property, the following uses are strictly prohibited:
sharing course materials with others
uploading course content to social media or file sharing platforms
distributing or reselling pattern files
reproducing patterns in digital or printed form for resale
using patterns to create your own pattern products or courses
creating derivative pattern products based on our materials.
The patterns and course materials remain the protected property of the Australian Fashion Institute.
10. Commercial use responsibility
Our patterns and materials are provided as tools for creative and commercial use.
Any garments produced using these materials are manufactured independently by the user.
The Australian Fashion Institute is not responsible for:
the quality or safety of garments produced by users
product liability relating to garments sold by users
claims made by customers of users.
Users are responsible for ensuring that garments they produce and sell comply with all applicable consumer, safety and labelling laws.
11. Payments and refunds
All purchases must be paid in full at the time of purchase.
Refunds are subject to our Refund Policy.
Nothing in these Terms excludes or restricts any rights you may have under the Australian Consumer Law, including rights to a refund, repair or replacement where goods or services are faulty or not as described.
12. Educational disclaimer
The courses, patterns and materials provided by the Australian Fashion Institute are intended for educational and informational purposes only.
While we aim to provide high-quality professional training, we do not guarantee specific outcomes, including:
business success
income generation
employment opportunities
commercial results.
Individual outcomes depend on factors including experience, skill level, effort and market conditions.
13. No professional advice
The information provided in our courses and materials does not constitute:
financial advice
legal advice
business advice.
Participants should obtain independent professional advice before making business or financial decisions.
14. Limitation of liability
To the maximum extent permitted by law, the Australian Fashion Institute and Clarke Holdings Group Pty Ltd will not be liable for any indirect, incidental or consequential loss arising from:

participation in courses
use of patterns or materials
commercial activities conducted by users.
This includes loss of:
income
profits
business opportunities
reputation.
Where liability cannot be excluded under the Australian Consumer Law, our liability is limited to:
resupply of the services
replacement of materials
refund of the purchase price.
15. Indemnity
You agree to indemnify and hold harmless the Australian Fashion Institute, Clarke Holdings Group Pty Ltd and their directors, employees and affiliates from any claims, damages, liabilities or expenses arising from:
your use of the website
your breach of these Terms
garments produced or sold using our patterns
any commercial activity undertaken using our materials
claims made by third parties relating to products manufactured by you.

16.Changes to these Terms
We may update these Terms from time to time. Updated versions will be published on our website.

These Terms are governed by the laws of the Australian Capital Territory, Australia.
Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory.
